1. About Plately

Hey Plately Pty Ltd ("Plately", "we", "us" or "our") provides a personalised meal planning service via heyplately.com.au and associated mobile applications. Plately generates weekly meal plans, recipes, and shopping lists tailored to your household's preferences and nutritional goals.

By creating an account and using Plately, you agree to be bound by these Terms of Service. If you do not agree, please do not use our service.

2. Eligibility

You must be at least 18 years of age to create a Plately account and use our service. By using Plately, you confirm that you meet this requirement.

3. Your account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Please notify us immediately at hello@heyplately.com.au if you suspect unauthorised access.

You agree to provide accurate and complete information when creating your account and to keep it up to date.

4. Subscription and billing

Plately offers a free trial period followed by paid subscription plans. Details of current pricing and plan options are available on our website.

• Free trial: New users receive a limited free trial period to explore the service. No credit card is required to start a trial.
• Paid plans: After your trial expires, continued access requires a paid subscription. Subscription fees are charged in Australian dollars (AUD) and include GST where applicable.
• Billing cycle: Subscriptions are billed monthly or annually depending on your chosen plan.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are provided for unused time within a billing cycle.
• Refunds: We handle refund requests on a case-by-case basis. To request a refund, contact us at hello@heyplately.com.au.

5. Health disclaimer

Plately is a meal planning tool, not a medical or dietetic service.

The meal plans, recipes, nutritional information and calorie estimates provided by Plately are generated for general informational purposes only. They are not a substitute for professional medical, dietary or nutritional advice.

If you have a medical condition, serious dietary restriction, eating disorder, or are pregnant or breastfeeding, please consult a qualified healthcare professional or registered dietitian before making changes to your diet based on content generated by Plately.

Nutritional values shown in meal plans are estimates. Actual values will vary depending on specific ingredients, brands and preparation methods used.

6. Acceptable use

You agree to use Plately only for its intended personal, household meal planning purposes. You must not:

• Use the service for any unlawful purpose
• Attempt to access, scrape or extract data from the service beyond normal use
• Share your account credentials with others or allow multiple people to use a single account concurrently (except where a family plan is available)
• Attempt to reverse-engineer or reproduce any part of the service
• Use the service to develop a competing product

7. Intellectual property

All content, features, and functionality of the Plately service (including but not limited to software, design, text, graphics and meal plan templates) are owned by Hey Plately Pty Ltd and are protected by applicable intellectual property laws.

The meal plans, recipes and shopping lists generated for your personal use are yours to use freely for personal, non-commercial household purposes. You may not republish, sell or distribute them without our written permission.

8. Availability and changes

We aim to keep Plately available at all times but cannot guarantee uninterrupted access. We may update, modify or temporarily suspend the service at any time. We will endeavour to provide notice of significant changes where reasonable.

9. Limitation of liability

To the maximum extent permitted by Australian law, Hey Plately Pty Ltd is not liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Plately service.

Our total liability to you for any claim arising out of or relating to these Terms or your use of Plately will not exceed the amount you paid to us in the 3 months preceding the claim.

Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot be excluded by contract.

10. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

11. Termination

You may close your account at any time. We reserve the right to suspend or terminate your account if you breach these Terms, without notice where the breach is serious.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of significant changes by email or in-app notice. Your continued use of Plately after any changes constitutes your acceptance of the revised Terms.
